TERMS AND CONDITIONS: WATCH TO WIN COMPETITIONS (“W2W”) 

 

The promoter is STV, Pacific Quay, Glasgow, G51 1PQ.  STV runs W2W competitions which feature at various days and times across STV’s broadcasting schedule.  Viewers are invited to enter W2W for the chance to win  prizes.   

 

STV is available via digital signal throughout the United Kingdom. The W2W website is available at www.stv.tv/win (the “Website”).

 

These terms and conditions (the “Terms and Conditions”) apply to all W2W competitions promoted by STV.

 

How to Enter

1.       Entries may be submitted by sending a SMS message starting with the keyword WIN, space, then choice of answer A, B or C to the shortcode 83788 (83STV) followed by the entrant's full name and town.

2.       Entries may be submitted by IVR by calling 0904 161 11 11 leaving your choice A, B or C followed by your name and telephone number.

 

Cost of Entry

3.       Entry by SMS is subject to a maximum charge of £1.50 per message in addition to the standard text messaging rate charged by your mobile telecommunications provider. You will not be able to cancel this charge once you have sent the SMS message.

4.       Entries submitted by IVR will be subject to a maximum charge of £1.50 per message in addition to the standard network charges of your telephone service provider. Mobile phone rates may vary and you are advised to contact your service provider for details.

 

Entrants: eligibility

5.       Any person who is an employee or an immediate family member of an employee of STV or any other person who is directly connected with the organisation of any particular W2W is ineligible to participate.

6.       W2W is only open to residents of the UK, Channel Islands and the Isle of Man.

7.       Entrants must be aged 18 years or over.

 

Conditions of Entry

8.        Entrants are deemed to have read and understood the Terms and Conditions and agree to be bound by them. 

9.       The closing date and time of W2W will be specified within the W2W promotion broadcast on STV.  All entries must be received by STV by the closing date and time specified.   

10.    All eligible entries received by the closing date and time specified shall be entered automatically upon submission.

11.    Entries received either by SMS or IVR after the closing date and time specified shall not be entered into the draw and SMS entries after the closing date and time may still be charged by the entrant’s network provider.

12.    Entries that are incomplete will be deemed invalid.

13.    You may only submit entries on your own behalf.  No third party entries, bulk entries or entries submitted by agents shall be accepted.

14.    STV shall not be responsible for any entries that are misdirected, lost, damaged in transmission, delayed for technical or other reasons, or received after the closing date and time.

15.    Entrants are liable for their costs to access telephone, mobile or computer networks.  Costs are as set out above and as specified in the W2W competition promotion broadcast on STV. 

16.    STV reserves the absolute right to disqualify any entrant to any competition which it considers has used improper technical means to enter. 

17.    Proof of texting shall not be taken as proof of receipt of entry.

18.    By entering W2W, entrants consent to their first and last name and town of residence being broadcast on STV and on its Website in the event that the entrant is the prize winner.

 

The Prize

19.     STV reserves the right at its absolute discretion to substitute a similar prize of equivalent or greater value if for any reason a prize is unavailable.

20.    No prize(s) shall be exchanged or transferred.  Prizes are not substitutable for cash.

21.    Only one prize per W2W shall be awarded per household.

22.    STV shall endeavour to deliver prizes within 28 days from the date the winner is published, except in the event of a Force Majeure Event as set out in Clause 41.     

23.    Where a prize is provided by a third party (the “Prize Donor”), the winner(s) shall be required to complete any additional formalities directly with the Prize Donor,  including without limitation, booking forms, signing up to and abiding by the Prize Donor’s reasonable terms and conditions. STV shall not have responsibility for the acts or defaults of the Prize Donor or any other third party.

24.    Prizes requiring travel shall be restricted as follows unless otherwise stated in the W2W promotion:  (i)  Travel to and from the prize destination shall not form part of the prize and shall be paid for by the winner(s); (ii) All travel, holiday, health and insurance shall be the responsibility of the prize winner(s); (iii) Where travel dates are restricted, the prize must be taken up within those dates; and (iv) where travel dates are not specified, all travel and holiday prizes shall be taken within one year of the date of the competition draw.

25.    The prize winner is solely responsible for any expenses not specified in the prize description.

 

The Prize Winner (the “Winner”)

26.    The Winner(s) name(s) shall be selected in a random draw from all correct answers received within the closing date and time specified.

27.    If the Winner (s) cannot be traced after reasonable efforts having been made by STV then STV may dispose of the prize as it thinks fit without any liability to the Winner (s) for having done so.

28.    The prize winner when contacted will be required to comply with these competition terms and conditions, accept the prize and provide their name, telephone number and address details in order that the prize can be delivered to them

29.    The Winner(s) shall be announced on STV after the closing date and time specified on the Website  and/or notified within seven days after the Winner (s)) has been ascertained.

30.    Names of  the Winner (s)  are available from STV upon request.

31.    The Winner (s) is required to participate in any publicity connected with the competition promotion if requested.

 

Personal Details and Unsolicited Marketing

32.    In the event that you are the Winner , you agree to provide the necessary information to deliver your prize.  This may include your name, telephone and address and telephone number. 

33.    You agree that all personal information disclosed to STV during the competition process are correct.

 

Legal Information

34.    All decisions of STV are final and binding. No correspondence shall be entered into.

35.    STV reserves the right to amend the Terms and Conditions at any stage without notice to the participants.

36.    STV shall not be liable in any way for any losses arising directly or indirectly from any failure or delay in performing any of its obligations under these Terms and Conditions caused by any force majeure event.“Force Majeure Event”means an event, inability or delay that is caused by circumstances beyond STV’s reasonable control and which cannot be cured by measures which might reasonably be taken in the course of that relevant party’s business, including war, terrorism, riot, civil commotion, accident, breakdown, damage to machinery or equipment or technology, fire, floods, snow, acts of God, regulatory, legislative or administrative interference, ruling or decision provided that no circumstance or cause shall be considered to be beyond the control of a party if it arises as a result of STV’s failure to take reasonable care. 

37.    The Terms and Conditions are governed by and shall be construed in accordance with Scots law and the Scottish Courts shall have non-exclusive jurisdiction.
